As part of a defamation lawsuit filed by Elisha Yared against media personality Ben Caspit, correspondence between Caspit and Shin Bet spokeswomen was revealed in court.
According to the Honenu organization, which represents Yarde, the correspondence shows that the Shin Bet spokeswoman passed on to Kaspit information that they claim was taken from the criminal record, which serves as the basis for publications that dealt with Yarde's appointment as spokeswoman for MK Limor Son Har Melech.
The documents that Caspit submitted as part of his defense line include screenshots of correspondence in which he was given data including the number of arrests of Yared, the date of the last arrest, and a clarification that this was an "administrative removal and not an administrative arrest.".
It was also claimed that after Kasfit asked to verify that this was Elisha Yared, the Shin Bet spokeswoman responded in the affirmative and added additional details regarding administrative deportation orders.
The Honenu organization claims that to the extent that the information is indeed taken from the criminal registry, it is information protected under the Criminal Information Law and the Returns Regulation, which stipulates that this type of information will only be disclosed to entities authorized to do so by law.
They claim that journalists are not among the parties authorized to receive this information, and therefore its transfer, if indeed it was made, raises legal questions.
Attorney Menashe Yado Mehonenu, who represents Yarde: "According to Ben Caspit's confession, the Shin Bet gave him criminal information from Yarde's police record, and this is a criminal offense. This information was used by Caspit to publicly attack the intention to appoint Yarde as a spokesperson for MK Limor Son Har Melech.".
He added: "The serious question arises here - is there some kind of joint working relationship between the Shin Bet and Ben Caspit for political and parliamentary needs, and within this framework the Shin Bet is ostensibly committing criminal offenses?""
