
The Lavie organization – Civil Rights, Proper Administration and the Encouragement of Settlement submitted a petition to the High Court of Justice today (Thursday), through Attorney Yitzhak Bam, demanding that the Legal Advisor to the Government, the State Attorney, and the Deputy State Attorney make a decision in the case of MK Gilad Kariv, who is suspected of leaking a secret protocol of the Foreign Affairs and Security Committee to a journalist.
Alternatively, the organization requests that the court oblige the enforcement authorities to announce when they intend to make a decision in the case.
This is a classified protocol from a confidential discussion of the Foreign Affairs and Security Committee, held in June 2023 with the participation of the Prime Minister, in which sensitive security threats were reviewed.
The discussion was classified as secret, Knesset members were required to deposit their phones at the entrance, and the minutes were kept under strict security procedures. However, despite this, extensive excerpts from the secret minutes were subsequently published in the media.
According to the petition, the Knesset officer's examination revealed that only one Knesset member had reviewed the minutes in the period prior to publication, and that markings were found on the copy exactly in the sections published in the media.
Following the findings, an investigation was opened, MK Gilad Kariv was questioned with a warning, and in July 2025 the investigation file was transferred to the State Attorney's Office. However, another year has passed since then, and to this day no decision has been made on whether to file an indictment or close the case.
The petition claims that this is an unreasonable delay, especially when it comes to suspected security violations involving the leakage of classified information. It is further claimed that the conduct of the enforcement authorities is contrary to their duty to make decisions within a reasonable time and respond to citizens' inquiries, and that the harm is not only to law enforcement but also to the public's trust in equality before the law.
The Lavie organization further emphasizes that the leak of classified minutes of the Foreign Affairs and Defense Committee does not only harm the confidentiality of a single document, but undermines the entire parliamentary oversight mechanism. If security officials and the Prime Minister cannot trust that confidential discussions will remain confidential, the Knesset's ability to oversee the security establishment and the security echelon's trust in elected officials will be harmed.
The petition also alleges selective enforcement, comparing it to the swift conduct of the Legal Advisor to the Government in the case of MK Tali Gottlieb, compared to the prolonged delay in making a decision in Karib's case.
In light of all of this, the Lavi organization is asking the Supreme Court to order the enforcement authorities to make a decision without delay on the question of bringing MK Gilad Kariv to justice, or at least to set a binding date for making the decision.
Attorney Yitzhak Bem: "Gali Baharav-Miara is recognizing the law and is making a club assumption about Gilad Kariv, since both are apparently members of the same left-wing political club. Baharav-Miara's failures in handling the Kariv affair are an insult to the rule of law and equality before the law, and I hope that the Supreme Court will set a limit to the discrimination favorably applied by Baharav-Miara to MK Kariv.""
