The State Attorney's Office filed an indictment today (Tuesday) with the Beersheba District Court against 12 members of the Prison Service for the reckless death of security prisoner Taar Abu Atseb and the assault on eight additional prisoners in Ketziot Prison.

Abu Atseb was a terrorist who belonged to the Fatah movement and was sentenced to 25 years in prison even before the events of October 7.

The indictment, filed by Attorney Tal Cohen Adir of the Southern District Attorney's Office, indicates that in November 2023, one of the defendants served as the shift commander in the compound where the prisoners were held and was responsible for counting them.

The remaining defendants served as guards, fighters from the 'Keter' unit, and a dog.

On November 18th, at noon, Abu Atseb asked the shift sergeant if there was a "hudna" in the war, and the matter was passed on to the shift commander.

According to the indictment, following the events of October 7, the procedures for counting security prisoners in the prison were changed, and during the evening count, the prisoners were required to sit on their knees with their hands raised and held behind their heads and facing the cell door. Normally, it was noted, the guards and fighters of the 'Keter' unit do not enter the cell during the count, unless an exceptional need arises.

The indictment includes another detail regarding the background that preceded the event: Even before the events in the cell, the shift commander shared with some of the defendants "his difficult feelings regarding the deaths of soldiers of Druze origin in battle.".

And so, this time, before the evening count, the shift commander held a briefing for the force, recounted Abu Atseb's words, and instructed the defendants that they would exceptionally enter the cell during the count, in order to "show the prisoners that there is no ceasefire.".

The shift commander made it clear that he would take responsibility for anything that happened and even warned the guards who were present at the briefing not to enter the cell so that they would not be harmed.

The shift commander then led the force to the cell where the deceased and eight other prisoners were. After beginning to count the prisoners, he ordered the defendants to enter the cell.

According to the indictment, the defendants joined together with the aim of beating and bruising the prisoners, and attacked them with fists, kicks, and some also with clubs.

The shift commander was in charge of what was happening and even beat one or more prisoners himself. After a few minutes, he ordered the force to stop, and the defendants left the cell without any of them reporting the attack or any unusual incident during the count.

Some time later, the security prisoner collapsed and lost consciousness. He was taken to the prison clinic and later to Soroka Hospital, where he was pronounced dead.

According to the indictment, his death was caused by the beatings he suffered. The prosecution details serious injuries to his heart and respiratory system, including broken ribs and tears in his heart muscle, along with additional injuries to his face and limbs. The other eight prisoners suffered serious injuries.

In another charge, the shift commander and the shift sergeant are accused of obstructing an investigation.

According to the indictment, after the police investigation began, the shift sergeant instructed one of the guards to lie during his interrogation regarding the use of batons.

The shift commander is credited with having, after being interrogated, asked, through another guard, a female guard who had not yet been interrogated to coordinate her version with the versions of the accused.

The guard initially gave a false version, but later admitted that she had lied and gave her version of the incident.

All defendants are charged with negligent homicide, aggravated assault, and multiple counts of aggravated assault. The shift commander and the shift sergeant are also charged with obstruction of justice during an investigation.

[24
607,66512,4881,66355
post-1063122","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-24","tag-607","tag-66512","tag-4881","tag-66355
