The Ombudsman for Judges has published three decision summaries dealing with conduct during legal proceedings and relations with litigants.<\/p>\n\n\n\n
The decisions dealt with a warning against charging expenses as part of an attempt to reach agreements, maintaining equality of trial in investigations, and canceling a hearing on the morning it was supposed to take place.<\/p>\n\n\n\n
One of the complaints examined the conduct of a presiding judge in the Rabbinical Court towards an unrepresented litigant, in an attempt to bring the parties to an agreement: In a complaint filed with the Commission, the complainant claimed that during a hearing on a divorce suit filed against him, at a time when he was not yet represented by a lawyer, the presiding judge warned him that if he did not sign the divorce agreement, his refusal would "cost" him 10,000 shekels in legal costs. <\/p>\n\n\n\n
According to the complainant, at this stage of the discussion he did not understand the meaning of the agreement at all and asked not to sign anything without being given legal advice that would clarify the significance of the agreement. <\/p>\n\n\n\n
After reviewing the complaint, the Commissioner, retired Judge Asher Kola, found the complaint justified, and clarified that presenting a possible charge for expenses in the amount of NIS 10,000 next to the complainant's announcement that he was not willing to sign or get a divorce before receiving legal advice could have been interpreted as applying pressure to agree to the court's proposal.<\/p>\n\n\n\n
Another complaint was received about the questioning of a lawyer during a hearing at the Rabbinical Court: Halina complains that during a hearing, the man's attorney was allowed to question the woman for a long time, while the woman's attorney was not given a corresponding opportunity to question the man. <\/p>\n\n\n\n
During the investigation of the complaint, it was found that the court itself had extensively investigated both parties and believed that the factual communication necessary for a decision had been exhausted. However, the Commissioner commented that if one party was given the power to investigate the opposing party's case, it would have been appropriate to consider providing a parallel opportunity for the other party to investigate the opposing party's case. <\/p>\n\n\n\n
This is in order to maintain judicial equality and the appearance of justice.<\/p>\n\n\n\n
Another complaint was received about the cancellation of a hearing only on the morning of the hearing in small claims court: The complaint filed with the commission alleged that a senior registrar in a small claims court did not handle for six months a request from a municipality that was sued to strike out the lawsuit outright due to lack of jurisdiction. <\/p>\n\n\n\n
Moreover, only on the morning of the hearing itself did the registrar issue a ruling ordering the outright deletion, resulting in the cancellation of the hearing scheduled to take place less than four hours later. According to the complainant, this conduct by the registrar resulted in the loss of a day of work and unnecessary preparation for the complainant. <\/p>\n\n\n\n
