The Likud Supreme Court today (Wednesday) unanimously approved the retention of Minister Haim Katz on the party's list, and unanimously the retention of Defense Minister Yisrael Katz and Foreign Minister Gideon Sa'ar.

This lifted the interim order that delayed the vote on Haim Katz's immunity.

The petition against the reservation was filed by the "Trustees of the Land of Israel" in the Likud, Attorney Aviad Wesoli and Attorney Aryeh Toivo, against Likud Chairman Benjamin Netanyahu and a number of officials and institutions in the party. The petitioners claimed, among other things, that the reservations create a conflict of interest and that the regulations do not allow for a reservation for a candidate who has already registered to run in the primaries.

With regard to Israel Katz, the court ruled that his immunity was based on a previous decision, which approved the move for exceptional reasons related to security needs and the good of the movement.

As for Gideon Sa'ar, it was determined that his armor stems from the joint campaign agreement between the Likud and the state right. After the Likud's legal advisor clarified that the assignment would be made within the framework of the armor quota already approved for the movement's chairman, the petitioners withdrew their claims against the move.

The main dispute in the court concerned Chaim Katz. Attorney Yitzhak Bem believed that one should wait until after the primaries before he could be reserved. On the other hand, Attorney Rafi Booker determined that Section 16 grants the Likud chairman the authority to reserve a candidate even before the primaries, and does not distinguish between an external candidate and a minister or Knesset member who has already registered to run. In his opinion, the "screaming" mechanism after the primaries is an additional route and does not limit the general authority to reserve candidates.

The president of the court, Attorney Michael Kleiner, joined Booker's position, thus creating a majority to approve the appointment of Haim Katz. Kleiner added that the appointment of "a successful minister and an experienced Knesset member who has proven his loyalty to the party" is preferable, in his opinion, to a candidate from outside the party.

The court also rejected the claims of conflict of interest. The ruling stated that there was no room to base determinations on "rumors and journalistic ducks," and that the claim that Haim Katz's immunity was given as a political reward was not proven.

Along with approving the reservations, all members of the panel criticized the manner in which the procedure was conducted. They determined that in the future, it would be appropriate for proposals for reservations to be forwarded to members of the Likud Secretariat at least 48 hours before the start of voting, to allow them to review, consider, and decide in an orderly manner.

The ruling reads: "We unanimously approve the reservations of Israel Katz and Gideon Sa'ar and the secretariat's approval procedures from now on, and by majority vote, the reservation of Haim Katz.".

[1
7898,66273
post-1061379","post","type-post","status-publish","format-standard","has-post-thumbnail","hentry","category-1","tag-7898","tag-66273
