B., a resident of Beersheba, who was hospitalized at Soroka when an Iranian missile hit the wing where he was staying, was recently recognized by the National Insurance Institute as a victim of a hostile act - despite a previous medical and psychological background. <\/p>\n\n\n\n
B. was hospitalized in the internal medicine department at the medical center due to liver problems. On one of the days of his hospitalization, while he was under the debilitating effects of medication, a loud explosion was suddenly heard near him, and severe pain spread through his legs. <\/p>\n\n\n\n
He said that following the missile strike, a lot of dust and objects began flying around him, and when the chaos settled down, the extensive destruction caused to the ward could be seen. He said that all of the patients in the ward were hastily released to other hospitals, or transferred to other wards in Soroka.<\/p>\n\n\n\n
B. himself was hit in both legs by shrapnel. The shrapnel was removed from his legs, he was bandaged in a hospital, and released home.<\/p>\n\n\n\n
After the incident, B. began to suffer from pain, numbness, and burning sensations in his legs. At the same time, he also began to suffer from anxiety, difficulty sleeping, flashbacks, and recurring memories of the missile incident.<\/p>\n\n\n\n
After the incident, B. decided to apply to the National Insurance Institute on his own and demand recognition as a victim of hostilities, but the recognition process was not simple at all, partly because B. had suffered from a previous medical condition even before the incident.<\/p>\n\n\n\n
The medical material he submitted to the National Insurance Institute indicated that B. had previously suffered from back pain and spinal findings. In addition, the medical material also revealed that B. had previously sought brief psychological treatment following marital tensions and anxiety attacks.<\/p>\n\n\n\n
The first medical committee determined that the leg injuries were only superficial, treated with washing and bandaging, with no orthopedic injury and no need for medication. The committee found small scars along the calves, but determined that B. had no remaining orthopedic disability.<\/p>\n\n\n\n
B. later underwent a nerve conduction test that indicated nerve damage in his legs. This finding sparked another medical controversy: whether the source of the pain and numbness was the shrapnel damage from the missile incident, or whether it stemmed from a medical condition prior to the incident.<\/p>\n\n\n\n
Some of the doctors on the committee attributed the neurological findings to B's liver problems, while others linked it to multiple shrapnel injuries. The medical committee concluded its deliberations and determined that B suffers from a low temporary disability, and that he is not entitled to significant compensation, beyond a low lump sum of several thousand shekels.<\/p>\n\n\n\n
In his distress, B. turned to attorney Michaela Dimertz, who is involved in struggles to realize medical rights for victims of hostilities and National Insurance disabled people.<\/p>\n\n\n\n
Attorney Demertz filed an appeal on his behalf against the decision of the first medical committee, and attached numerous additional medical documents indicating the worsening of B's \u200b\u200bcondition due to the missile strike.<\/p>\n\n\n\n
In the appeals committee, Attorney Dimertz claimed that since the missile hit, Marsha has suffered from pain in his feet, ankles, and knees, a phenomenon that began and stems from the injury he sustained in the serious incident. The committee determined that it would not discuss the nerve damage in the orthopedic framework, but decided to examine the scars left on B.'s legs following the absorption of the shrapnel, and determined that he had permanent disability of 10% for them.<\/p>\n\n\n\n
At the same time, a medical committee was appointed for B. in the mental field. B. claimed in the committee that since the missile fell near him, he has had difficulty coming to his senses, suffers from sleep problems and mood swings, and suffers from flashbacks of the shock he felt and the destruction he was exposed to in the ward. The committee was presented with documents according to which after the event B. was diagnosed as suffering from post-traumatic stress disorder, began medication treatment, and later even increased the dosage of the medications he takes on a daily basis.<\/p>\n\n\n\n
Very recently, the psychiatric committee determined that B. was indeed exposed to a traumatic event due to the missile strike in the ward where he was hospitalized. Along with recognizing that some of his difficulties are related to a previous medical background, the committee determined that the event left him with a mental injury, even if only temporarily, and granted him temporary disability at a rate of 25% until the end of May 2027.<\/p>\n\n\n\n
According to Attorney Dimertz, in May 2026, B. was paid a retroactive payment of 43,981 shekels for ten months, or approximately 4,390 shekels per month. This amount is expected to continue to be paid to him monthly until the end of the temporary disability period.<\/p>\n\n\n\n
As stated, the medical committee also recognized B.'s scar as a permanent disability at a rate of 10%, which entitles him to an additional grant of approximately 62,000 shekels from the National Insurance Institute.<\/p>\n\n\n\n
At the end of the temporary disability period, B. is expected to appear before additional committees at the National Insurance Institute, which will examine whether he remains permanently disabled in the mental field, and if such a disability is determined, the amount of benefits he is entitled to may increase significantly.<\/p>\n\n\n\n
According to attorney Michaela Demertz, the case illustrates that even when the victim has a prior medical background, this does not rule out recognition of the injury caused by a hostile event.
