The Knesset committee headed by MK Ofir Katz approved this evening (Thursday) the proposal for the 'Basic Law: Torah Study' for second and third reading. <\/p>\n\n\n\n
This was after MK Ofir Katz's reservation was accepted stating that the second clause, which states that the purpose of "the Basic Law is to recognize the study of Torah as a fundamental value in order to create scales of justice against fundamental values \u200b\u200bin the State of Israel," which was approved in first reading, would be removed from the bill.<\/p>\n\n\n\n
6 Knesset members supported the proposal and 4 opposed it.<\/p>\n\n\n\n
Committee Chairman, MK Katz: "After discussions with our partners in the Haredi factions and after talks with many parties, including within the coalition, it was decided in cooperation to remove Article 2. So we are left with only the first article, which I believe is indisputable, that Torah study is a fundamental value and heritage of the Jewish people in the State of Israel. And not only did the coalition say this, many opposition members also said that if the second article was removed they would vote in favor of the law.". <\/p>\n\n\n\n
The committee chairman also emphasized that no fighter will be harmed by the approval of the law.<\/p>\n\n\n\n
In addition, MK Ofir Katz announced that the vote on the revision of the law will be held on Sunday: "We are working on a bill that will respond as much as possible to the needs and the outcry that has been here for several years. On Sunday, we will begin a debate on the law, vote on it, and then vote on 'Basic Law: Torah Study.' And I call on all members of the Knesset to come and support the law.".<\/p>\n\n\n\n
MK Naor Shiri: "The first remaining clause leaves the value of Torah study as a single value that is enshrined as a basic law. Not the value of service, not the value of treating victims of shock or troublemakers. This means that priority will be given to those who study Torah and all other values \u200b\u200bwill be secondary. This law is not declarative.".<\/p>\n\n\n\n
Deputy Attorney General, Adv. Avital Sompolinsky: "The committee will have to explain what the meaning of the fundamental value of Torah study is compared to the current situation. Is it, as was said throughout the discussions, that the goal is to give the court a tool it did not have before? Then deleting Section 2 does not change anything. If the meaning of deleting Section 2 leads us to believe that the value of Torah study that exists in the case law remains in the same balance, then all the explanatory statements that were in relation to the bill become irrelevant and the bill is truly declarative.".<\/p>\n\n\n\n
MK Yinon Azoulay: "Removing Section 2 is not to our liking. But we accepted your request. But I'm saying this here, I still believe that the first section does not talk about sanctions but rather that it will give the judge a tool when he comes to judge that he can discuss with discretion on issues such as the value of equality.".<\/p>\n\n\n\n
MK Yitzhak Goldknopf: "They didn't talk to me about removing Section 2 and I don't agree with it. I ask that the section remain, and I will oppose its removal.".<\/p>\n\n\n\n
Knesset Legal Advisor, Attorney Sagit Afik: "In fact, this bill in the preliminary stage referred to a much stronger wording and with quite clear practical implications. In preparation for the first reading, the wording was converted into two sections. My position on the first section was that it seeks to anchor the value of Torah study as a fundamental value. Regarding the second section, which referred to the balance of justice against other fundamental values, my position was that it has the potential for practical aspects. For other implications, such as budgetary impacts for soldiers and civil servants as well. <\/p>\n\n\n\n
\""Therefore, from the moment this section was removed, in my eyes, the effects and treatment of servants and soldiers no longer exist. I don't see how Section 1 can be interpreted as a section that has practical implications for harming or dividing the budget pie in a different way.
