The Tel Aviv Administrative Court today (Monday) dismissed the petition filed against Ramat Hasharon Mayor Yitzhak Rochberger, the Ramat Hasharon Municipality, and the 'Big' complex, regarding the opening of businesses on Saturday - but determined that the ruling should be seen as giving validity to the mayor and municipality's declaration that they will continue to enforce the existing bylaw, in accordance with the policy that was formulated.<\/p>\n\n\n\n
The petition was filed by Boris Cohen and the Histadrut Hapoel Hamizrahi against the mayor, the municipality, 'Big' Shopping Centers, which operates the 'Big Fashion Glilot' mall, and business owners. <\/p>\n\n\n\n
The request in the petition was to require the municipality to enforce the municipal bylaw on the opening and closing of businesses, and especially the provisions prohibiting the opening of businesses on Shabbat.<\/p>\n\n\n\n
The Ministry of Interior welcomed the ruling, which "clarifies that as long as the new by-law of the Ramat Hasharon municipality has not been legally approved, the existing by-law is binding, and the municipality must act to enforce it in accordance with its declaration before the court.".<\/p>\n\n\n\n
According to the Ministry of the Interior, "The existing bylaw, approved in 1967, prohibits the opening of businesses on Sabbaths and Jewish holidays, with limited exceptions stipulated therein. Therefore, as long as a new bylaw is not approved in the manner prescribed by law, the municipality cannot proceed according to a future arrangement or according to a reality created on the ground, but must enforce the applicable law.".<\/p>\n\n\n\n
The Interior Ministry noted that "the ruling validates a fundamental principle of the rule of law: a local authority is not entitled to refrain from enforcing a valid bylaw simply because it believes that a new arrangement is required.
