MK Yitzhak Kreuzer of Otzma Yehudit submitted today (Tuesday) a bill to reduce the age of criminal responsibility for serious crimes from 12 to 10.<\/p>\n\n\n\n
The explanatory notes to the bill state: "The age of criminal responsibility in Israel, as stipulated in the Penal Code, is 12 years. This means that a minor under the age of 12 who was involved in an offense, no matter how serious, cannot be indicted or criminal proceedings initiated against him, and he is exempt from punishment.".<\/p>\n\n\n\n
The explanatory notes also state: "However, recently we have witnessed a phenomenon of minors under the age of criminal responsibility, i.e. under the age of 12, who commit serious acts of violence. There is no justification for granting exemption from criminal proceedings to an 11-year-old minor who has committed a serious violent offense.".<\/p>\n\n\n\n
"Therefore, it is proposed that the age of criminal responsibility for a minor be lowered to 10 years for a serious crime, i.e. an offense punishable by seven years or more.".<\/p>\n\n\n\n
According to the bill, a minor over the age of 10 who has committed a serious crime punishable by seven years in prison or more, including murder, attempted murder, and other serious violent offenses, will be able to bear criminal responsibility and be prosecuted.<\/p>\n\n\n\n
Minister of National Security, Itamar Ben-Gvir: \u201cThis is an important, just and necessary bill that provides a response to the security and criminal reality of recent years and strengthens the security of Israeli citizens. A 10-year-old child who is capable of committing and taking part in a serious crime is also capable of standing trial. I expect that all relevant parties - the education system, social services and all state authorities - will join the joint effort to deal with the phenomenon and eradicate it.\u201d<\/p>\n\n\n\n
MK Yitzhak Kreuzer: "Recently, we have witnessed a serious phenomenon of minors under the age of 12 committing serious and life-threatening acts of violence, while they are protected under the guise of complete exemption from criminal responsibility. There is no moral or public justification for granting automatic immunity to an 11-year-old minor who commits a serious crime.
