The Supreme Court increased the sentence of Hamad Hamadi, a resident of Nazareth who had contact with elements acting on behalf of Iranian intelligence, set fire to vehicles, and assisted in infiltration into Israel from 6 to 7 years in prison.<\/p>\n\n\n\n
According to the indictment to which he confessed, during 2023, Hammadi was in contact with a Jenin resident who acted against elements connected to Iranian intelligence. <\/p>\n\n\n\n
As part of the connection, he carried out various tasks, including collecting and transporting infiltrators who crossed the border from Jordan, checking entry points at the border for the purpose of infiltrating Israel, and in June 2023, together with another person, he set fire to four vehicles on a street in Haifa where, according to their knowledge, Jews lived. <\/p>\n\n\n\n
Hamadi documented the arson and passed the documentation to his operator. In addition, despite suspicions that the missions were being carried out under Iranian direction and funding and that his operator was affiliated with the Islamic Jihad organization, he continued to stay in contact with him and even carried out additional missions for him.<\/p>\n\n\n\n
As part of the appeal, the Criminal Department of the State Attorney's Office, through attorneys Miri Columbus and Racheli Zuaretz-Levi, argued that the sentence imposed in the District Court does not sufficiently reflect the seriousness of the acts and the risk inherent in maintaining contact with elements acting on behalf of an enemy state. <\/p>\n\n\n\n
The prosecution emphasized that even when some of the tasks proposed to the defendant were not carried out, the mere continuation of contact with the hostile entity after real suspicions have arisen regarding its identity and objectives constitutes a significant danger to the security of the state. It was further argued that such contacts tend to develop gradually from seemingly marginal tasks to the execution of serious actions that harm the security of the state and its citizens. <\/p>\n\n\n\n
In addition, the Attorney General's Office pointed to the expanding phenomenon of recruiting Israeli citizens by Iranian elements to carry out various missions against the State of Israel, and to the need to increase the punishment in order to deter many.<\/p>\n\n\n\n
The Supreme Court accepted the position of the Attorney General's Office and determined that the offense of contact with a foreign agent is one of the most serious offenses in the Penal Code, due, among other things, to the potential for damage inherent in it and the risk it poses to state security. <\/p>\n\n\n\n
The Vice President, Justice Noam Solberg, emphasized that this offense has a wide "gate of entry," and that even contact that initially appears limited or marginal may later develop into serious and dangerous activity.
