The plaintiff is a blind man with significant prior experience working as a telephone representative. He applied for a position at the Har Al-Tahitiyan call center of Clal.
After a telephone interview, he clarified that he needed screen-reading software for the job. He was soon told that due to information security restrictions, the software could not be installed, and later, after another interview, his candidacy was rejected on the grounds that he was not professionally qualified for the position.
During the proceedings, it became clear that Clal did not conduct a serious examination of the accessibility options, did not involve the accessibility coordinator, did not examine alternatives, and did not give real weight to the plaintiff's professional experience.
At the same time, significant flaws were also found in the way the recruitment process itself was managed and documented.
The Labor Court accepted the claim, determined that all the facts indicate that discrimination based on disability occurred, and awarded the plaintiff 50,000 NIS in compensation and another 5,000 NIS in expenses - this, despite the fact that the plaintiff found another job shortly after the rejection, and suffered no real loss of income.
